Privacy Policy
This policy explains how Callum James Rosser trading as SmartECU Solutions (ABN 92 454 641 272) (“we”, “us”) handles personal information for the website smartecusolutions.com.au, SmartECU Desk, licence keys, and support.
It sits with the Terms of Service and Store Policy.
1. Who we are
SmartECU Solutions is a sole-trader workshop-software business in Western Australia. Contact: [email protected].
We follow the Australian Privacy Principles as a matter of practice. If the Privacy Act 1988 small-business exemption applies to us in a given year, we still use this policy so you know what we collect and why.
2. What we collect
We collect only what we need to sell and support Desk:
- Identity and contact — name, workshop name, email address, and any phone number you give us.
- Licence data — Machine ID, licensed email, seat quantity, trial or paid status, Desk version.
- Payment records — amount, date, plan (monthly or yearly), invoice or receipt. Card numbers are collected and stored by Stripe, not by us.
- Support — emails you send, screenshots, logs, or Machine IDs you attach so we can fix an Activate or overlay problem.
- Website — standard server logs (IP address, browser, pages requested), cookies needed for the site and checkout, and Google Ads measurement if you arrived from an ad (see section 8).
- Anonymous pull stats — on unless you turn the setting off in Desk (see section 6A).
Job cards, customer names, VINs, regos, ECU files, Job Packs, and printed sheets live on your workshop PC unless you email them to us for support. We do not pull those files off your computer. The optional stats setting does not send that material.
We do not collect health information, tax file numbers, or children’s data. Desk is sold to workshops, not to children.
3. How we collect it
- You type it in at checkout, in an email, or in Desk (Help → Copy machine ID).
- Stripe sends us payment confirmation and the email used at checkout.
- Desk may contact app.smartecusolutions.com.au to Activate a key and to check for updates.
- Unless you turn anonymous stats off in Settings, Desk may send the payload in section 6A to smartecusolutions.com.au after a job is marked Completed.
- The website host records ordinary access logs.
If you buy for a workshop, you confirm the people whose details you send us know you are giving them to us.
4. Why we use it
- Issue, move, or revoke a key tied to email + Machine ID
- Bill the subscription and send receipts or tax invoices
- Email product updates, renewal notices, and replies to support
- Stop licence abuse (shared keys, repeated trial resets)
- Keep records we need for tax and accounting
- Improve Desk when you send a log or bug report
- Build anonymous shop-stock numbers (engine family and mass band), unless you turn that setting off
We do not sell mailing lists. We do not use your workshop customer list for our marketing. We will not send promotional email you did not ask for; transactional mail (key, invoice, security) is part of the product.
5. Who we share it with
We share personal information only with:
- Stripe — payments, subscriptions, invoices, customer portal. Stripe’s privacy policy applies to card data.
- Hosting and email providers that run smartecusolutions.com.au, app.smartecusolutions.com.au, and our inbox.
- Accountants or the ATO if required for tax.
- Police or a court if Australian law requires it.
Some of those providers store data outside Australia (Stripe commonly uses facilities in the United States and other countries). We only use them to operate checkout, email, and hosting.
We do not sell, rent, or swap your information with other tuners, parts suppliers, or advertisers.
6. Machine ID and job data
A Machine ID identifies the workshop PC, not a person by name. We treat it as personal information when it is stored next to your email.
If you email a datalog, VIN, Job Pack, or customer sheet for support, we use it only to diagnose that request and then delete it when it is no longer needed, unless you ask us to keep it on the job. Support tickets you choose to send are separate from anonymous stats.
6A. Anonymous pull stats
Desk Settings include a tick: Share anonymous pull stats. It is on after you accept the terms, unless you turn it off. Unticking it stops further sends and clears the local queue.
When it is on, and only after you mark a job Completed, Desk may send:
- engine family (for example 1VD / 1GD) and a mass band (for example 2800–3200 kg)
- job type (Performance / Diagnostics / App development)
- rounded peak road-load kW and Nm for factory and modified, where those logs exist
- channel header names from the road log (for example Engine Speed, MAP)
- whether a Probe 22 request was acknowledged, refused, or not run
- a copy of the road-log CSV with customer, VIN, plate, path and name columns removed, and with a filename that does not contain the plate or customer
Desk does not send customer name, plate, VIN, file paths, Machine ID, notes, overlay images, ECU binaries (.bin / .hex), or the Job Pack zip through this setting.
We use that payload to improve column mapping and to publish aggregated “shop stock” figures. We do not publish a public stock cell for a family and mass band until several unrelated jobs sit in that cell. We do not sell these stats.
A rare truck can still be unique in a small sample. We round peaks and do not attach dates or plates to the public shelf. If you want a file deleted from this pipe, email us from the licensed address. We cannot un-mix a number that has already been folded into an aggregate with n ≥ 5.
7. Storage and security
Licence and billing records are stored with our email, Stripe, and the activation server. We use unique keys per PC and do not publish customer lists.
No method of transmission is perfectly secure. Do not send card numbers by email. Pay through Stripe Checkout.
We keep billing records for at least five years where tax law requires it. We keep Machine ID and email for as long as the seat exists and for a reasonable period after cancellation so we can stop a reused key.
8. Cookies and the website
The site may use essential cookies or host logs so pages load and Stripe Checkout can return you to a success page.
If you reach the site from a Google ad, we use the Google Ads tag to measure that visit and, where set up, a Setup download. Google may set or read cookies for that measurement. We do not use that tag inside the Desk application. See Google’s advertising policies for how they handle that data.
9. Your choices
Email [email protected] to:
- see what we hold about your licence
- correct a name, email, or workshop detail
- move a seat to a replacement PC
- ask us to delete records we no longer need
- ask us to drop queued anonymous stats that have not yet been folded into an aggregate
To stop anonymous pull stats, turn the setting off in Desk → Settings. That is the control. We do not need an email to stop future sends.
We may refuse to delete information we must keep for tax, a dispute, or to enforce the licence (for example a Machine ID used to stop a copied key). We will say so if that is the case.
To stop marketing email, reply “unsubscribe”. Checkout and key emails will still be sent while you have a seat.
If you are not satisfied, you can complain to us first. You may also contact the Office of the Australian Information Commissioner at oaic.gov.au.
10. Changes
We may update this policy. The current version will be at smartecusolutions.com.au/privacy. If we make a material change to how we use your information, we will email the licensed address where practical.
